Terms and Conditions for Customers

Welcome to THC Store (operated by THC Store India Private Limited, hereinafter "THC Store", "we", "us", "our", or "the Platform"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "you", "your") and THC Store governing your access to and use of the THC Store website, mobile applications, and all related services. By creating an account, browsing products, placing an order, booking a consultation, or using any feature of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Definitions

In these Terms, the following words and expressions shall have the meanings assigned to them below:

• "Account" — your registered customer account on THC Store, identified by your email address and protected by your password.
• "Brand Partner" / "Seller" — a third-party business entity registered on the Platform that lists and sells Products.
• "Cart" — the virtual shopping cart where you add Products before placing an Order.
• "Cannabis-Derived Product" — any Product derived from or containing extracts of the Cannabis sativa L. plant, including hemp seed oil, hemp protein, CBD (cannabidiol) isolate, hemp fibre products, and Ayurvedic bhang-based preparations, sold in compliance with applicable Indian law.
• "Consultation" — a medical consultation session (online or in-person) booked through the Platform with a registered Doctor.
• "Content" — any text, images, reviews, ratings, questions, or other material you submit to the Platform.
• "Doctor" — a licensed medical practitioner registered and verified on the Platform who provides Consultations.
• "Hemp" — Cannabis sativa L. plant or parts thereof containing not more than 0.3% THC (tetrahydrocannabinol) by dry weight, as recognised under applicable Indian state hemp policies and FSSAI regulations.
• "Membership" — a paid subscription plan (Silver, Gold, or Diamond) providing enhanced benefits.
• "Order" — a confirmed purchase of one or more Products placed through the Platform.
• "Prescription" — a medical prescription issued by a Doctor through the Platform or uploaded by you, authorising the purchase of prescription-required Products.
• "Products" — health, wellness, Ayurvedic, herbal, hemp-derived, nutraceutical, and related items listed on the Platform.
• "Wallet" — your THC Store wallet that holds credits from refunds, loyalty point redemptions, and promotional credits.

2. Eligibility & Account Registration

2.1 Age Requirements

You must be at least 18 years of age to create an account on THC Store. Certain product categories (including specific cannabis-derived and hemp products) may impose additional age requirements as mandated by applicable state law or product-specific regulations. THC Store reserves the right to request age verification at any time. Providing false age information is a violation of these Terms and applicable Indian law.

2.2 Age Verification

THC Store may require you to upload a government-issued identity document for age verification. Accepted documents include:

• PAN Card
• Aadhaar Card
• Voter Card
• Driving Licence
• Passport

Documents are stored securely on encrypted cloud storage (AWS S3). You certify that all documents submitted are genuine, unaltered, and belong to you. Falsification of identity documents is a criminal offence under Indian law and will result in immediate account termination and reporting to authorities.

2.3 Registration Information

During registration, you must provide:

• First Name (2–50 characters, letters and spaces only)
• Last Name (2–50 characters, letters and spaces only)
• Email Address (valid format, unique — one account per email)
• Phone Number (valid Indian mobile number)
• Date of Birth
• Gender
• Password (minimum 8 characters; stored as a salted bcrypt hash — never in plaintext)

You agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your password and for all activities under your Account. Notify us immediately at support@thcstore.in if you suspect unauthorised access.

2.4 Email Verification

Upon registration, your Account is set to inactive. A 6-digit one-time password (OTP) will be sent to your registered email address. The OTP is valid for 5 minutes. Your Account will not be activated until email verification is successfully completed. If the OTP expires, you may request a new one.

2.5 Phone Number Verification

THC Store may require verification of your mobile number via OTP for certain transactions (e.g., checkout, profile updates). The OTP is valid for a limited period and must be entered correctly to proceed.

2.6 One Account Per Person

Each individual may maintain only one active Account. Creating multiple Accounts to circumvent Platform rules, exploit promotions, abuse referral programmes, or bypass suspensions is strictly prohibited. Detection of duplicate Accounts will result in suspension or permanent termination of all associated Accounts and forfeiture of all benefits, wallet balance, and loyalty points.

2.7 Social Login

You may register or log in using third-party authentication providers (Google, Facebook). When you use social login, we receive your email address, display name, and profile picture from the provider. A THC Store Account is created or linked automatically. You remain bound by these Terms regardless of your login method.

3. Account Security

3.1 Password Requirements

Your password must be at least 8 characters long. We strongly recommend using a mix of uppercase, lowercase, digits, and special characters. Passwords are hashed using the bcrypt algorithm with a salt factor of 12 and are never stored or transmitted in plaintext.

3.2 Failed Login Attempts & Account Lockout

After 10 consecutive failed login attempts, your Account will be temporarily locked for 30 minutes. During lockout, you cannot log in even with the correct password. This protects your Account from brute-force attacks. After the lockout period, the attempt counter resets automatically.

3.3 Two-Factor Authentication (2FA)

You may enable 2FA for enhanced security. When enabled, a 6-digit OTP will be sent to your registered email on each login. The OTP is valid for 10 minutes. 2FA is optional but strongly recommended, especially if your Account is linked to prescriptions or medical records.

3.4 Session & Token Management

Upon login, an access token (valid for 4 hours) and a refresh token (valid for 7 days) are issued and stored as secure httpOnly cookies. On logout, tokens are immediately blacklisted and cannot be reused. You should log out from shared or public devices.

3.5 Password Reset

If you forget your password, you may request a reset link via email. The reset link contains a secure token valid for 30 minutes. You may not request more than one reset link per minute. Upon successful reset, all existing sessions are invalidated and you must log in again.

3.6 Suspicious Activity

THC Store records your IP address and user agent at each login. If unusual activity is detected (login from a new device/location, multiple failed attempts), you may receive a security alert. You must report any suspected unauthorised access immediately.

4. Products & Ordering

4.1 Marketplace Model

THC Store is a marketplace facilitator under the Consumer Protection (E-Commerce) Rules, 2020 issued under the Consumer Protection Act, 2019. Products are listed and sold by independent Brand Partners. THC Store does not manufacture, warehouse (except through Brand Partner warehouses), or independently guarantee any Product. Product descriptions, images, ingredient lists, nutritional information, certifications, and claims are provided by the respective Brand Partner. THC Store facilitates the transaction but the contract of sale is between you and the Brand Partner.

4.2 Product Information

While Brand Partners are contractually required to provide accurate product information, THC Store does not independently verify every claim. If you have allergies, medical conditions, or dietary requirements, you should carefully review product labels and consult a healthcare professional before purchase. Report inaccurate listings to compliance@thcstore.in.

4.3 Prescription-Required Products

Certain Products are marked with a "Prescription Required" badge. To purchase such Products, you must:

• Obtain a digital Prescription through a Consultation with a Doctor on the Platform, or
• Upload a valid Prescription from your own physician (subject to verification)

Prescriptions are valid for the duration specified by the issuing Doctor (typically 90 days) and are limited to the specific Products listed therein. Expired Prescriptions cannot be used. Attempting to purchase Prescription-required Products without valid authorisation, forging Prescriptions, or misrepresenting medical need is a serious violation of these Terms and applicable law (Drugs and Cosmetics Act, 1940).

4.4 Pricing

• All prices are displayed in Indian Rupees (INR) and are inclusive of applicable GST (Goods and Services Tax)
• The price at the time of Order confirmation is the final price
• Prices may change without prior notice, but confirmed Orders are honoured at the Order-time price
• In the event of a pricing error (e.g., a product listed at ₹1 instead of ₹1,000), THC Store or the Brand Partner may cancel the Order and issue a full refund

4.5 Product Availability

Product availability is checked at the time of checkout. Stock levels are managed by Brand Partners and may change between the time you add a Product to your Cart and the time you complete checkout. If a Product becomes unavailable after Order confirmation, the Brand Partner will notify you, cancel the affected item, and issue a refund.

4.6 Order Placement & Acceptance

Placing an Order constitutes an offer to purchase. THC Store and/or the Brand Partner reserve the right to accept or reject any Order based on:

• Product availability
• Pricing errors
• Suspected fraud or abuse
• Delivery serviceability to your pincode
• Prescription validation (for Prescription-required Products)
• Regulatory restrictions on certain products to your state or territory

An Order is considered confirmed only upon receipt of an Order confirmation notification with an Order ID.

4.7 Order Lifecycle

Orders follow this lifecycle:

1. Pending: Order placed, awaiting Brand Partner confirmation
2. Consultation Booked (if applicable): Doctor Consultation booked for Prescription Products
3. Prescription Pending (if applicable): Awaiting Prescription from Doctor
4. Prescription Received (if applicable): Prescription verified and linked to Order
5. Confirmed: Brand Partner confirms the Order; tax invoice generated
6. Processing: Order is being packed for shipment
7. Shipped: Order handed to logistics partner; AWB tracking number assigned
8. Delivered: Order delivered to your address

Orders may also be Cancelled (by you before shipping, or by the Brand Partner), Return Requested (by you after delivery), or Refunded.

4.8 Order Cancellation

You may cancel an Order at any time before it is shipped. Once shipped, cancellation is no longer available — you must wait for delivery and initiate a return as per the Return & Refund Policy. If a Brand Partner cancels your Order (due to stock issues, quality concerns, etc.), you will receive a full automatic refund and a credit note.

4.9 Invoices

For every confirmed Order, a tax invoice is generated in the format INV/FY/SEQUENCE (e.g., INV/2526/00001) containing product details, quantities, prices, GST breakup (CGST + SGST or IGST), HSN codes, Brand Partner GSTIN, and your billing and shipping addresses. Invoices are available for download from your Order history.

5. Cannabis-Derived, Hemp & Ayurvedic Products

5.1 Legal Status of Products on THC Store

THC Store exclusively lists and sells products that are legal under applicable Indian law. This includes:

• Hemp-derived products: Products derived from industrial hemp (Cannabis sativa L.) with THC content not exceeding 0.3% by dry weight, including hemp seed oil, hemp protein powder, hemp hearts, hemp fibre textiles, and hemp-based cosmetics
• Ayurvedic preparations: Traditional Ayurvedic formulations containing bhang (cannabis leaves) or vijaya (cannabis extract) that are manufactured under valid AYUSH manufacturing licences and comply with the Drugs and Cosmetics Act, 1940 and relevant Ayurvedic pharmacopoeia standards
• CBD (Cannabidiol) products: Products containing CBD isolate or broad-spectrum hemp extract that comply with FSSAI and AYUSH regulations, with THC content within permissible limits
• Nutraceuticals & supplements: Health supplements, dietary supplements, and nutraceutical products regulated under FSSAI (Food Safety and Standards Act, 2006)

5.2 NDPS Act Compliance

THC Store does not sell, facilitate the sale of, or promote any substance controlled under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985. Under Section 2 of the NDPS Act, the following parts of the Cannabis plant are exempt from the definition of "cannabis" and are therefore legal:

• Seeds of the cannabis plant
• Mature stalks and fibre derived therefrom
• Any preparation (such as bhang) made from the leaves of the cannabis plant (regulation varies by state)

Products containing charas (hashish/cannabis resin), ganja (flowering or fruiting tops of the cannabis plant), or any substance classified under the NDPS Schedules are strictly prohibited on the Platform. Any attempt to use the Platform to procure controlled substances is illegal and will be reported to law enforcement.

5.3 State-Specific Regulations

Cannabis and hemp regulations vary significantly between Indian states. Certain products available on the Platform may not be deliverable to all states due to state-specific restrictions. If a product cannot be shipped to your state under local law, the Order will be rejected and a full refund will be processed. You are responsible for being aware of and complying with the laws of your state regarding the possession and use of hemp and cannabis-derived products. THC Store provides state-wise availability information on product pages where applicable.

5.4 Health & Medical Disclaimers

Products listed on THC Store — including hemp, Ayurvedic, herbal, and nutraceutical products — are not intended to diagnose, treat, cure, or prevent any disease unless they are specifically classified as drugs under the Drugs and Cosmetics Act, 1940 and sold under a valid drug licence with appropriate prescription. Health claims made by Brand Partners are their responsibility and are subject to:

• FSSAI regulations on health claims for food products and supplements
• AYUSH guidelines on claims for traditional medicine
• Advertising Standards Council of India (ASCI) guidelines on health-related advertising
• Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954

Always consult a qualified healthcare professional before using any health or wellness product, especially if you are pregnant, nursing, taking medication, or have a pre-existing medical condition.

5.5 Product Testing & Certificates of Analysis

Hemp and cannabis-derived products listed on the Platform are required to carry valid third-party lab Certificates of Analysis (CoA) verifying THC content, cannabinoid profile, and absence of contaminants (heavy metals, pesticides, microbial contamination). You may request a product's CoA through the product page or by contacting compliance@thcstore.in.

5.6 No Resale or Export

Products purchased on THC Store are for your personal use only. You must not resell, redistribute, or export cannabis-derived or hemp products purchased on the Platform. Export of hemp products from India is subject to separate licensing requirements under the Directorate General of Foreign Trade (DGFT) and the NDPS Act.

6. Shopping Cart

6.1 Cart Behaviour

• Your Cart is maintained per Brand Partner (separate cart per brand)
• For authenticated users, the Cart persists in the database indefinitely until checkout or manual clearing
• For guest users, the Cart is stored server-side and expires after a configured period
• Maximum 50 items can be synchronised per cart operation

6.2 Cart Features

• One coupon may be applied per Cart
• Prescription IDs may be attached to the Cart for Prescription-required Products
• Membership discount is applied automatically if you have an active Membership
• Loyalty points may be redeemed at checkout
• Billing and shipping addresses are saved per Cart

6.3 Price Changes

Product prices may change between the time you add them to your Cart and the time you complete checkout. The price at checkout confirmation is the final price. If a Product's price increases significantly, you will be notified at checkout.

7. Payments

7.1 Accepted Payment Methods

Method	Details
Online Payment	Credit/debit cards (Visa, MasterCard, RuPay), UPI, Net Banking, and other methods supported by Razorpay. All payments processed through Razorpay's PCI-DSS Level 1 compliant infrastructure.
Cash on Delivery (COD)	Available for eligible orders up to ₹5,000. Not available for Prescription-required Products. A COD handling fee may apply (displayed at checkout). Repeated failed COD deliveries may result in COD privileges being revoked.
THC Store Wallet	Use your Wallet balance (from refunds, loyalty redemptions, or promotional credits) for full or partial payment.
Payment Links	Secure Razorpay payment links sent for manual orders, Consultations, follow-up fees, or subscription payments. Links expire after 7 days.

7.2 Payment Security

THC Store does not store your full card numbers, CVV, or bank credentials. All payment data is processed directly by Razorpay. Payment confirmations are verified through cryptographic webhook signature validation to prevent tampering.

7.3 Failed Payments

If a payment fails, the Order will not be confirmed. Any amount debited from your account will be automatically refunded by Razorpay within 5–7 business days. Do not place a duplicate Order unless the original shows as "Failed" in your Order history.

7.4 Payment Disputes

If you believe you have been incorrectly charged, contact support@thcstore.in within 30 days of the transaction. We will investigate and resolve the dispute within 15 business days. Filing fraudulent chargebacks or payment disputes is a violation of these Terms and may result in Account termination.

8. Delivery

8.1 Delivery Partners

Orders are shipped via our logistics partners — Shiprocket, Delhivery, or brand-managed delivery (where applicable). The logistics partner is determined based on your pincode, order weight, and Brand Partner configuration.

8.2 Delivery Charges

Delivery charges are calculated based on order value, total weight, destination pincode, and the Brand Partner's shipping configuration. Additional charges may include COD handling fee (capped at ₹100), fuel surcharge, and remote area surcharge. Free shipping may be available for orders above a threshold, for Membership holders, or during promotional periods.

8.3 Delivery Timelines

Estimated delivery dates are displayed at checkout and in your Order confirmation. These are estimates only, not guarantees. Actual delivery may vary due to logistics capacity, weather, location, regulatory checks, public holidays, or other factors beyond our control.

8.4 Shipment Tracking

Once shipped, you will receive an AWB (Airway Bill) tracking number via email and in-app notification. You may track your shipment in real-time through your Order detail page or on the logistics partner's website.

8.5 Delivery Restrictions for Regulated Products

Certain hemp-derived and cannabis-derived products may be subject to delivery restrictions in specific states or union territories based on local regulations. Orders for such products will be checked against a state-wise serviceability matrix. If delivery is restricted to your location, you will be notified at checkout or your Order will be rejected with a full refund.

8.6 Failed Deliveries & Return to Origin (RTO)

If delivery fails (incorrect address, customer unavailable after multiple attempts, refusal to accept), the shipment will be returned to the Brand Partner. A re-delivery may be arranged at additional cost, or a refund processed after deducting applicable RTO and shipping charges. Repeated delivery failures may result in COD privileges being revoked.

8.7 Delivery Verification

Upon delivery, you may be required to provide an OTP, signature, or ID for verification — particularly for prescription products and high-value orders. If the delivered Product appears damaged, do not accept the delivery and contact support immediately.

9. Guest Checkout

You may place an Order without creating an Account ("Guest Checkout"). During Guest Checkout, you must provide first name, last name, email, phone number, date of birth, and a shipping address. An Account is automatically created for you with a system-generated password, marked as a guest account. Your email becomes your login credential. Guest Accounts are marked as email-unverified. Guest Checkout is not available for Prescription-required Products.

10. Doctor Consultations

10.1 Booking & Types

You may book Consultations with verified Doctors through the Platform. Available types include Online (Video) and In-Person consultations. Consultation fees are set by individual Doctors and displayed before booking. Fees must be paid in advance via Razorpay. Free Consultations may be available through applicable coupons.

10.2 Appointment Lifecycle

Pending → Confirmed → Paid → In Progress → Completed. Appointments may also be Cancelled or Rescheduled.

10.3 Follow-Up Consultations

After an initial Consultation, your Doctor may schedule a follow-up at a discounted rate (typically 50% of the original fee). Follow-up types include routine check-ups, medication reviews, test result discussions, and treatment progress assessments. A payment link will be sent to you for the follow-up fee, valid for 7 days.

10.4 Consultation Disclaimer

Consultations are advisory in nature. Doctors provide professional medical guidance based on the information you share, but the Platform does not guarantee any specific health outcomes. THC Store facilitates the connection but does not supervise clinical decisions. For emergencies, please visit your nearest hospital — the Platform is not a substitute for emergency medical services.

10.5 Prescriptions

If a Doctor issues a Prescription, it will be available in your Account under "My Prescriptions". Each Prescription specifies patient details, diagnosis, medicine names with dosage, frequency, and duration, specific Products available on THC Store linked to the Prescription, and validity period (typically 90 days). You must not share, alter, or misuse Prescriptions.

10.6 Consultation Recordings

Consultations may be recorded with your explicit consent for quality assurance and dispute resolution. Recordings are stored securely and retained as per the Privacy Policy. You may decline recording without affecting the Consultation.

10.7 Cancellation of Consultations

You may cancel a booked Consultation before the scheduled time. Consultation fees are refundable only if the Doctor cancels or fails to attend (full refund), a technical failure on THC Store's end prevents the Consultation (full refund), or you cancel within the free cancellation window (if applicable). Refunds for completed Consultations are not available.

11. Loyalty & Rewards Programme

11.1 Loyalty Tiers

Tiers are calculated based on your lifetime cumulative points. Tier upgrades are automatic and immediate.

11.2 Earning Points

• Points earned on eligible purchases are multiplied by your tier multiplier
• Minimum order value to earn points: ₹200
• Daily earning cap: 500 points | Weekly earning cap: 2,000 points
• Points for approved product reviews (one-time per product)

11.3 Daily Check-In

Earn points by checking in daily (Day 1: 3 pts → Day 7: 25 pts). Check-ins must be on consecutive calendar days. Missing a day resets the streak. Weekly streak bonuses escalate from 25 to 150 points. Only one check-in per day.

11.4 Spin Wheel

THC Store may offer a loyalty spin wheel where you can spend points to spin for prizes including bonus points, discount coupons (valid for 7 days, single use), free shipping coupons, or percentage discounts. Spins are serialised to prevent concurrent exploits.

11.5 Redeeming Points

Points may be redeemed for Wallet credits at the conversion rate displayed in your account. There is a 24-hour cooldown between redemptions. Points cannot be transferred between Accounts, exchanged for cash, or applied retroactively to past Orders.

11.6 Point Expiration

Loyalty points expire 365 days after being earned. You will receive a warning notification 7 days before points are due to expire. Expired points cannot be reinstated.

12. Memberships

12.1 Membership Tiers

THC Store offers three paid Membership tiers — Silver, Gold, and Diamond — with benefits including enhanced product discounts, free or reduced delivery, early access to flash deals, priority support, and coupon stacking privileges.

12.2 Duration & Renewal

Memberships are for a fixed duration (typically 365 days). Auto-renewal is optional. If auto-renewal is off, the Membership expires at the end of the term.

12.3 Membership Discounts at Checkout

Membership discount is applied first to the product total; coupon discount is applied second. Each has independent maximum discount caps. Memberships may set a minimum purchase amount and cap the maximum coupon discount percentage when stacking.

12.4 Non-Refundability

Membership purchases are non-refundable once activated. If purchased but not yet activated, a refund may be requested within 7 days.

13. Product Subscriptions

You may subscribe to receive Products on a recurring basis (weekly, bi-weekly, monthly, or bi-monthly). Subscriptions charge your payment method on each billing cycle at the current price. A Razorpay payment link is generated for each cycle (valid 7 days). You may pause, skip, cancel, or resume subscriptions at any time. If a subscribed Product becomes unavailable, you will be notified.

14. Referral Programme

• Each customer receives a unique referral code (6–20 alphanumeric characters)
• Referrer bonus: 200 loyalty points per successful referral
• Referee bonus: 100 loyalty points upon registration with a referral code
• A referral is counted when the referee completes their first Order
• Self-referral, fake account referrals, or automated abuse will result in forfeiture of all earned bonuses and Account suspension

15. Coupons & Promotions

15.1 Coupon Types

Percentage discount, fixed amount, free product, free consultation, free service (delivery), and buy X get Y.

15.2 Coupon Rules

• Only one coupon per Order — coupons do not stack with each other
• Coupons may have minimum order requirements, maximum discount caps, usage limits, and validity periods
• Coupons cannot be applied to Product Bundles
• Expired, fully-used, or inactive coupons will be rejected at checkout

16. Reviews & User Content

You may submit one review per Product (1–5 star rating plus text). Reviews displaying a "Verified Purchase" badge are from customers with a confirmed delivered Order. All reviews are subject to moderation. Reviews must not contain profanity, personal attacks, spam, false claims, or content violating IP or privacy rights. By submitting Content, you grant THC Store a non-exclusive, royalty-free, perpetual, worldwide licence to display, reproduce, and distribute it on the Platform.

17. Wallet

• Your Wallet holds legacy credits only. It is not a refund destination — refunds go back to the original payment method, and Cash on Delivery orders are refunded by bank transfer to the account details you provide
• Wallet balance can be used for full or partial payment on any Order
• Wallet balance is non-transferable and non-withdrawable as cash
• Wallet balance may be forfeited upon Account termination for Terms violations

18. Communications

18.1 Transactional Communications (Mandatory)

You consent to receiving essential communications including order confirmations, shipping updates, payment receipts, appointment reminders, prescription notifications, security alerts, and policy update notices. These cannot be opted out while your Account is active.

18.2 Marketing Communications (Opt-In)

Promotional emails, newsletters, and personalised offers are sent only with your consent. You may opt out at any time via the unsubscribe link or your Account notification preferences.

19. Prohibited Conduct

You shall not:

1. Provide false, misleading, or fraudulent information during registration, age verification, or ordering
2. Create multiple Accounts to circumvent restrictions, exploit promotions, or abuse referral/loyalty programmes
3. Attempt to purchase Prescription-required Products without a valid Prescription
4. Forge, alter, share, or misuse medical Prescriptions or certificates
5. Use the Platform to procure, distribute, or promote any substance controlled under the NDPS Act, 1985
6. Misrepresent the intended use of cannabis-derived or hemp products (e.g., purchasing for recreational drug use when marketed as dietary supplements)
7. Resell, redistribute, or export products purchased on the Platform, particularly cannabis-derived products subject to DGFT/NDPS restrictions
8. Use automated bots, scrapers, crawlers, or similar tools to access or extract data from the Platform
9. Attempt to exploit security vulnerabilities, reverse-engineer the Platform, circumvent rate limits, or bypass access controls
10. Engage in fraudulent transactions, deliberate chargebacks, payment manipulation, or money laundering
11. Manipulate product reviews, ratings, questions, or helpfulness votes
12. Harass, threaten, defame, stalk, or abuse other users, Doctors, Brand Partners, or Platform staff
13. Upload malicious software, viruses, or code designed to disrupt the Platform
14. Impersonate another person, medical professional, or Platform representative
15. Use the Platform for any purpose that violates any applicable Central or State law

20. Account Suspension & Termination

20.1 By THC Store

THC Store reserves the right to suspend, restrict, or permanently terminate your Account for violation of these Terms, fraudulent or illegal behaviour, failure to pay for confirmed Orders, deliberate chargeback abuse, repeated delivery failures, or as required by law or regulation.

20.2 Consequences of Termination

• Pending Orders may be cancelled
• Wallet balance may be forfeited (except where prohibited by law)
• Loyalty points expire immediately; Memberships cancelled without refund; Subscriptions terminated
• Access to Prescriptions and medical records revoked (copies available on request within 30 days)

20.3 By You

You may deactivate your Account at any time through Account settings or by contacting support@thcstore.in. Active Orders must be completed or cancelled before deletion. Data is retained as per the Privacy Policy retention schedule.

21. Intellectual Property

All content on the Platform — including the THC Store name, logo, website design, software, databases, text, graphics, icons, photographs, and UI/UX elements — is the intellectual property of THC Store or its licensors. You may not reproduce, copy, distribute, modify, frame, mirror, or create derivative works without prior written permission.

22. E-Commerce Compliance

THC Store operates in compliance with the Consumer Protection (E-Commerce) Rules, 2020 and the Consumer Protection Act, 2019. As a marketplace e-commerce entity, THC Store:

• Displays the name, contact details, and GSTIN of each Brand Partner on their product listings
• Provides a clear return, refund, exchange, warranty, and guarantee policy
• Does not manipulate the price of Products to gain unreasonable profit or discriminate between consumers of the same class
• Does not adopt any unfair trade practice, whether online or offline
• Maintains a Grievance Officer accessible at grievance@thcstore.in
• Ensures that no Brand Partner registered on the Platform is selling Products that are unsafe or violating any law

23. Data Protection

THC Store processes your personal data in compliance with:

• The Digital Personal Data Protection Act, 2023 (DPDP Act) — you have rights including access, correction, erasure, grievance redressal, and the right to nominate
• The Information Technology Act, 2000 and IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011
• The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021

24. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• THC Store is a marketplace facilitator and is not liable for the quality, safety, legality, or suitability of Products sold by Brand Partners
• THC Store is not liable for any adverse health effects, allergic reactions, or side effects from the use of any Product, including cannabis-derived, hemp, Ayurvedic, or nutraceutical products
• THC Store is not liable for medical outcomes resulting from Doctor Consultations, Prescriptions, or treatments
• THC Store is not liable for delivery delays, damage in transit, or logistics partner failures
• Our total aggregate liability for any claim shall not exceed the amount paid by you for the specific Order or service giving rise to the claim in the 12 months preceding the event
• In no event shall THC Store be liable for indirect, incidental, special, consequential, or punitive damages

25. Indemnification

You agree to indemnify, defend, and hold harmless THC Store, its directors, officers, employees, agents, and affiliates from and against all claims, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising from your use or misuse of the Platform, your violation of these Terms or any applicable law, infringement of third-party rights, any Content you submit, your misuse of Prescriptions or medical certificates, or your unlawful use of any Product purchased through the Platform.

26. Dispute Resolution

26.1 Customer Support

For any issues, you may raise a support ticket through the Platform. Tickets are assigned to support agents with SLA response and resolution deadlines.

26.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of India.

26.3 Arbitration

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator. The seat of arbitration shall be New Delhi, India. The language of proceedings shall be English.

26.4 Jurisdiction

Subject to the arbitration clause, the courts of New Delhi, India shall have exclusive jurisdiction.

26.5 Consumer Grievance

You may also escalate unresolved issues to the National Consumer Helpline (1800-11-4000) or the Consumer Disputes Redressal Forum/Commission under the Consumer Protection Act, 2019.

27. Modifications to These Terms

THC Store reserves the right to modify these Terms at any time. When material changes are made, a new version will be published, a summary of changes will be provided, and you will be required to review and accept the updated Terms before continuing to use the Platform. Your acceptance is recorded with timestamp, IP address, and user agent for audit purposes.

28. Force Majeure

THC Store shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, pandemics, government actions or regulatory changes, wars, civil unrest, strikes, internet outages, power failures, cyberattacks, or changes in applicable cannabis/hemp regulations.

29. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

30. Entire Agreement

These Terms, together with the Customer Privacy Policy, Customer Store Policy, and Return & Refund Policy, constitute the entire agreement between you and THC Store regarding your use of the Platform.
